In short: you top up credit, you pay only for results delivered, unused credit never expires, and you are responsible for how you contact the people in your results.
1. Who we are, who these terms apply to
BananaLead (the “Service”) is operated by P209, SAS (simplified joint-stock company), SIREN 917 694 218, 78 avenue des Champs-Élysées, bureau 326, 75008 Paris, France (“BananaLead”, “we”). These terms form a contract between BananaLead and the company or professional that creates an account (the “Customer”, “you”).
B2B only. The Service is reserved for professionals acting for the purposes of their trade, business or profession. By creating an account you confirm you are not a consumer. Consumer protection rules (including the statutory withdrawal right) therefore do not apply. If you accept these terms for a company, you confirm you are authorised to bind it.
Creating an account, topping up credit or calling the tools (from the website, the API or the MCP connector) means you accept these terms in their version in force on that date.
2. The Service
BananaLead provides on-demand B2B data tools: lookups of public LinkedIn, Crunchbase and PitchBook information, an email finder and an SMTP email verifier, a website email extractor, Google Maps local business search, a Shopify / WooCommerce stores database, and YouTube / TikTok / Instagram creator search. The tools can be used from the web app, through API keys, or from AI assistants (Claude, ChatGPT and others) through the MCP connector.
Results come from publicly available sources and third-party providers at the time of the request. We do our best to make them accurate and fresh, but we do not guarantee that a given search returns results, nor that every result is accurate, complete or current (for example, an email marked valid can later bounce). The Service is provided on a best-effort basis.
3. Account
Accounts are managed through our identity provider. You must give accurate information, keep your credentials and API keys confidential, and tell us without delay at legal@bananalead.com if you suspect unauthorised use. You are responsible for all activity on your account, including calls made with your API keys or by AI assistants you connected.
4. Prices and prepaid credit (Terms of Sale)
- Prepaid credit. The Service works on prepaid credit in US dollars. You top up your balance by card through our payment provider Stripe (minimum amount shown at checkout).
- Credit never expires. Unused credit stays on your account with no time limit while the account is open.
- Pay per delivered result. Each tool is billed per result actually delivered, at the unit prices shown on the Pricing page at the time of the request. A search that returns nothing costs nothing.
- Free tiers. Every tool includes a free allowance (per run and per month) shown on the Pricing page. Free tiers may be changed or withdrawn at any time and cannot be exchanged for money.
- MCP connector. The connector itself is free; the tools it calls are billed per result like anywhere else.
- Price changes. We may change prices at any time. New prices apply to requests made after they are published, never to results already delivered.
- Taxes and invoices. Prices are shown excluding taxes. French VAT is applied where required (reverse charge for EU businesses with a valid VAT number, as applicable). Invoices are available from your account.
5. Refunds
- Consumed credit (results delivered) is not refundable.
- Unused credit from a top-up can be refunded on request sent to legal@bananalead.com within 14 days of that top-up. The refund is made to the original payment method, for the unused part of that top-up only.
- After 14 days, credit is no longer refundable but remains usable without time limit.
- If a technical failure on our side charged you for results that were not delivered, write to us and we will credit your balance back.
6. Acceptable use
You agree to use the Service and its results lawfully and fairly. In particular you must not:
- send spam or unsolicited bulk messages, or use results for harassment, discrimination, fraud, phishing or any illegal purpose;
- contact people without complying with the rules that apply to you and to them, including the GDPR, the ePrivacy rules (in France, article L.34-5 of the Postal and Electronic Communications Code), CAN-SPAM, CASL and equivalent laws — for example by identifying yourself, keeping messages relevant to the recipient’s professional role, and honouring every opt-out immediately;
- process sensitive data or build profiles of private individuals outside a professional context;
- resell, publish or redistribute the results as a database or a competing service;
- attempt to bypass rate limits, billing or security, reverse engineer the Service, or overload it.
We may suspend or close an account that breaches this section, without refund of credit used in breach.
7. Personal data in results
Results may contain professional personal data (names, job titles, professional emails, public profiles). For your own use of these results — storing them, enriching your CRM, contacting people — you act as an independent data controller and are solely responsible for having a valid legal basis, informing the people concerned (GDPR art. 14) within one month at the latest or at the first contact, honouring their rights and their objections, and keeping the data only as long as needed.
BananaLead acts as the provider of the Service and as controller for its own collection and processing, described in the Privacy policy. People can object at any time through the opt-out form; you agree to delete data about a person who asks us or you to stop processing it.
8. Intellectual property
The Service, its software and content remain the property of P209. We grant you a non-exclusive, non-transferable right to use the Service and, subject to section 6, to use the results you paid for in your own business.
9. Liability
We are bound by an obligation of means. We are not liable for indirect damages such as loss of profit, revenue, business, data or reputation, nor for the use you make of the results. In any case, our total liability for any claim is capped at the amounts you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
You will indemnify BananaLead against any claim, fine or cost arising from your breach of these terms or of applicable law, in particular sections 6 and 7.
10. Availability, suspension, termination
We may interrupt the Service for maintenance or for reasons beyond our control (including changes by data sources). You may close your account at any time by writing to legal@bananalead.com; unused credit then follows section 5. We may close an account inactive for a long period after prior notice by email.
11. Changes
We may update these terms. The version in force is the one published on this page; significant changes are announced by email or in the app before they apply. Continuing to use the Service after that date means you accept them.
12. Governing law and courts
These terms are governed by French law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the courts of Paris, France, including in case of multiple defendants or third-party claims. If one clause is held invalid, the others remain in force.
